When is the Appropriate Time to Ask for an Attorney?

But why is it so important to ask for an attorney in these situations? First and foremost, asking for an attorney can be like pressing pause on the situation. Once you request an attorney, the police are no longer allowed to interrogate you. This means that any statements you make after requesting an attorney may not be admissible in court. However, it's important to be clear in asserting your right to an attorney. Simply asking if you need an attorney or saying that you think you need one may not be enough to stop the police from questioning you. To effectively press the "pause" button, you need to clearly state: "I want a lawyer."


Depending on the circumstances, once you request an attorney, the police are no longer allowed to interrogate you. Because the circumstances in which this protection applies can be difficult to define, you should apply the rule: When in doubt, ask for a lawyer. If you are unsure of how to assert your right to an attorney, it can be helpful to have a phrase memorized in advance. In the stress of the moment, it can be easy to forget your rights or become flustered. By having a clear phrase in mind, i.e., "I want a lawyer" you can confidently and effectively request an attorney.
