Protect Your Fifth Amendment Rights!

Over my 33 years of experience as an Attorney, I am still surprised that many people whose liberty is at risk because of a police investigation continue to think or believe that they are required to speak with the police about an investigation.


The Fifth Amendment of the United States Constitution, Right against Self Incrimination, affords a person the right not to speak with the police about an investigation.


Please keep in mind that many police departments do not record or videotape interviews. Without legal Counsel or without asserting your right to consult Legal Counsel, anything you say could be misconstrued by the police and used against you. Also, your demeanor or reaction to certain investigative topics could be misconstrued and used against you.


When you are the focus of an investigation, you should consult a lawyer before you agree to speak with the police. You and your Attorney may agree to an interview if that is in your best interest. Remember, the police are not working in your best interest, and as such, it is important that you consult with Legal Counsel before you decide whether or not to speak with the police. You and your Attorney will develop a plan that is in your best interest.
